Morris County Media Services Center recognizes the federal Copyright Law of January 1, 1976 (Public Law 94-553) and the Congressional Guidelines for copyrighted materials established by the Kastenmeier Committee of the U.S. House of Representatives.
We recognize the sole right of copyright held by the owner of copyrighted materials.
Only lawfully made and procured materials are distributed to member schools for non-profit, board-approved uses.
Our hardware, software, facilities, or personnel will not be used to violate copyright laws and regulations.
We prohibit any user of our materials from unauthorized copying, public performance, broadcasting, telecasting or transmitting.
Users of our materials are responsible for seeing that materials are not used for copyright violations while in their care. We are not responsible for unlawful use of our materials by users.
We recognize the copyright positions of the Association of New Jersey County AVA Commissions, and the National Association of Regional Media Centers.
We call upon all educators and boards of education to recognize the Copyright Law of the United States and the policy of the commission.
We will maintain appropriate procedures to implement this policy and educate users in copyright laws, guidelines and policies on a continual basis.
Certain videos are licensed "For Home Use Only" but may be played publicly in non-profit academic schools under the FACE-TO-FACE TEACHING EXEMPTION. Teachers and schools are responsible to observe strict guidelines:
(1) Performance must be given by an instructor or pupil. Teacher & pupils must be together.
(2) It must involve a FACE-TO-FACE teaching activity, and be limited to systematic instruction - never for recreation, entertainment, or as a reward.
(3) It must take place in a non-profit educational institution, in a classroom or similar place devoted to instruction.
(4) The video must be lawfully made and procured. (A movie you copied at home, or rented from a local video dealer may not be lawfully made or procured for public performance.)
